Terms of Service

These Terms of Service (“Terms”) govern your use of the SimpleCalories Android application (the “App”) published by Victor Chung (“I”, “me”, or “the publisher”).

By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The App

SimpleCalories helps you log food, track calories and related metrics, and optionally sync data to the cloud when you sign in with Google.

The App is provided by Victor Chung as an individual publisher. “SimpleCalories” is the product name and is not presented here as a separately registered company.

2. Eligibility and accounts

• You must be old enough to form a binding contract in your region and meet any Google account requirements.
• Cloud features require Google Sign-In. You are responsible for keeping your Google account secure.
• You are responsible for activity that occurs under your account.

3. Acceptable use

You agree not to:

• Misuse the App, API, or community features (including spam, abuse, or attempts to disrupt service)
• Submit unlawful, infringing, or knowingly false community food data
• Reverse engineer or attack the App or backend except as allowed by applicable law
• Use the App in any way that violates law or third-party rights

I may suspend or terminate access if you violate these Terms or if continued use creates risk to users or the service.

4. Health disclaimer (not medical advice)

SimpleCalories provides general wellness and nutrition tracking tools only. It is not medical advice, diagnosis, or treatment.

Calorie estimates, AI meal scan results, database lookups, step data, and goal suggestions can be incomplete or inaccurate. Always use your own judgment and consult a qualified health professional for medical or dietary decisions.

You use health-related features (including Health Connect integrations and AI estimates) at your own risk.

5. Community content

If you submit foods to the community catalog, you grant the publisher a non-exclusive license to store, display, and share that product information with other App users. After account deletion, submissions may remain available with your submitter identity anonymized, as described in the Privacy Policy.

6. Third-party services

The App relies on third parties (for example Google Sign-In, Firebase Crashlytics, Gemini AI, nutrition data providers, cloud hosting, and Health Connect). Your use of those services may also be subject to their terms and policies. The publisher is not responsible for third-party outages or policy changes.

7. Intellectual property

The App’s code, design, and branding are owned by the publisher or its licensors. These Terms do not transfer ownership to you. You may use the App for personal, non-commercial purposes as provided through Google Play (or other authorized distribution).

8. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VICTOR CHUNG WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

IF LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE THREE MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those places, the limits apply to the fullest extent allowed.

10. Termination

You may stop using the App at any time and may delete your account in Settings. The publisher may stop offering the App or terminate accounts when reasonably necessary (for example abuse, legal requirements, or service shutdown).

Provisions that by nature should survive (including disclaimers, liability limits, and community licenses) survive termination.

11. Changes

I may update these Terms by posting a revised version with a new “Last updated” date. Continued use after changes constitutes acceptance. If you do not agree, stop using the App and delete your account.
