Terms of Service

These Terms of Service (the “Terms”) govern your use of the SimpleCalories Android application, API, and community catalog (together, the “Service”). The Service is published by Victor Chung (“I”, “me”, or “the publisher”).

By installing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What SimpleCalories does

SimpleCalories provides tools for logging food, tracking calories and related metrics, finding food information, and optionally syncing data to the cloud. Some features use independent third-party services. Features, integrations, and availability may change.

2. Eligibility and accounts

  • You must be old enough to form a binding contract in your region and meet any Google account requirements.
  • The Closed-test and Production launch listing is intended for adults aged 18 or older. This launch decision does not rewrite existing profiles whose stored date of birth is under 18; those records remain as entered, and age-restricted features continue to follow the App's implemented gate.
  • Cloud features require Google Sign-In. You are responsible for keeping your Google account secure and for activity under your account.
  • You must provide accurate information when an account or submission requires it and must not impersonate another person or organization.

3. Acceptable use

You must not:

  • use the Service for unlawful, fraudulent, abusive, or harmful activity;
  • spam, harass, disrupt, overload, probe, or attack the Service or its users;
  • reverse engineer, bypass access controls, or use automated collection where the Service or a source prohibits it;
  • submit content that infringes another person's rights, contains private information, or is knowingly false; or
  • use SimpleCalories to provide medical diagnosis, treatment, or emergency advice.

4. Community food catalog

Users and administrators may submit food and menu information to a shared catalog. Entries can be pending, reviewed, edited, normalized, approved, rejected, merged, hidden, or removed. Review does not mean that a manufacturer, restaurant, data provider, or health professional verified an entry.

Before you contribute a catalog entry you must accept these Terms and the Community data guidance. The App asks for that acceptance on the sign-in screen and again before upload. If you do not agree, do not submit catalog content.

When you submit an entry, you represent that:

  • you have a lawful basis to submit the information and to grant the permissions below;
  • the information is accurate to the best of your knowledge, or you clearly identify uncertainty;
  • you are not copying protected descriptions, photos, logos, private information, or an entire third-party database; and
  • the submission does not claim or imply sponsorship, affiliation, or endorsement that does not exist.

Manual entry does not remove obligations under a website's terms, copyright, trademark, database-rights, or other applicable rules. Use facts such as serving size and calories where you are allowed to use them, write descriptions in your own words, and follow the Community data guidance.

License for submissions

To operate the catalog, you grant the publisher a non-exclusive, worldwide, royalty-free license to host, reproduce, format, adapt for clarity, display, distribute, and make the submitted information available through the Service. This license continues for catalog copies that remain after account deletion, but the submission is detached from your identity where our systems support that process. This license does not transfer your ownership of a trademark or other rights you do not grant.

You may request a correction or raise a rights concern by using in-app Report on the catalog entry or by emailing victorchung2013@gmail.com. Repeated reports can hide an entry automatically at a configured threshold. I may restrict, hide, or remove content while reviewing a request, may resolve reports in administrator tools, and may disclose information where legally required.

5. Food, health, and AI disclaimers

SimpleCalories is a general wellness tool, not medical advice. Nutrition values, calories, allergens, ingredients, database results, step data, goals, and AI meal-scan results may be incomplete, stale, or wrong. Verify information against the current package, menu, or a qualified professional before making a safety-critical decision.

Do not rely on the Service for allergy management, medication decisions, diagnosis, treatment, or emergency care. You use health-related and AI features at your own risk. If an AI estimate looks wrong, edit it before you log it, and use in-app Flag to report the estimate.

6. Brands, sources, and third-party services

Restaurant, manufacturer, product, and provider names are used only to identify food information. Their names, marks, logos, photos, and content belong to their respective owners. SimpleCalories is independent and does not claim affiliation with or endorsement by those owners.

The Service may rely on Google Sign-In, Firebase Crashlytics, Gemini, Health Connect, hosting, database, and food-data providers such as USDA, Open Food Facts, FatSecret, or Nutritionix when configured. Their own terms, licenses, attribution, display, retention, and privacy rules may apply. FatSecret-backed features are subject to the fatsecret Platform API Terms of Use; FatSecret is an independent provider and does not endorse SimpleCalories.

7. Intellectual property

The Service's code, design, and SimpleCalories branding are owned by the publisher or licensors. These Terms give you a personal, non-exclusive, non-transferable right to use the Service through an authorized distribution channel. They do not transfer ownership to you.

8. Availability and disclaimers

The Service is provided “as is” and “as available” to the maximum extent permitted by law. I do not promise that it will be uninterrupted, secure, error-free, complete, current, or suitable for every purpose. Third-party services may change or become unavailable.

9. Limitation of liability

To the maximum extent permitted by law, Victor Chung will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, or goodwill, arising from the Service. If liability cannot be excluded, it is limited to the greater of the amount you paid for the Service in the three months before the event giving rise to the claim or USD $50. Some jurisdictions do not allow all limitations, so the limits apply only to the fullest extent allowed.

10. Suspension and termination

You may stop using the Service and delete your account at any time. I may suspend access, remove submissions, or stop offering the Service when reasonably necessary for abuse prevention, legal compliance, security, or service shutdown. Disclaimers, liability limits, intellectual-property terms, and catalog licenses that should survive will survive.

11. Changes

I may update these Terms by posting a revised version with a new “Last updated” date. Continued use after an update means you accept the revised Terms. If you do not agree, stop using the Service and delete your account.
